    • Στην παρούσα διπλωματική εργασία γίνεται επισκόπηση της νομοθεσίας που αφορά στις συμβάσεις των δημοσίων έργων από τις αρχές του 20ου αιώνα ως και σήμερα. Επιχειρείται έτσι, να εντοπιστούν οι αιτίες των νομοθετικών αλλαγών και αδυναμιών ώστε να σκιαγραφηθεί η πορεία και η κατεύθυνσή τους όσον αφορά στο προσυμβατικό στάδιο. Έχοντας λοιπόν ως προμετωπίδα την ολιστική μελέτη του δικαιακού πλαισίου, θα εξαχθούν συμπεράσματα που θα βοηθήσουν στη διατύπωση παραγωγικών προτάσεων- στοχευμένων αλλαγών, στην διαδικασία καθορισμού του αναδόχου στα δημόσια έργα. Ειδική μνεία γίνεται στην υπάρχουσα νομοθεσία Ν.3669/08, όπου με τη διατύπωση εν τέλει προτάσεων, επιδιώκεται η βελτίωση της διαδικασίας δημοπράτησης δημοσίων έργων ώστε να επιτευχθεί η διαχείριση του προϋπολογισμού, αλλά και η επιτάχυνση της μετάβασης από το προσυμβατικό στάδιο στην κατακύρωση του αποτελέσματος.
