    • This Master’s Thesis examines the principle of prevention in environmental law through the prism of contemporary technological developments, with particular emphasis on the application of artificial intelligence (AI). It argues that artificial intelligence has the capacity to strengthen preventive environmental governance by facilitating the early identification and assessment of environmental risks, the monitoring of pollution, the protection of biodiversity, and the provision of scientifically substantiated support for administrative decision-making.

The study critically analyses the international, European Union and Greek legal frameworks governing the principle of prevention, with particular reference to Article 191 of the Treaty on the Functioning of the European Union (TFEU), Article 24 of the Constitution of Greece, the Convention on Access to Information, Public Participation in Decision-making and Access to Justice in Environmental Matters (Aarhus Convention), and Regulation (EU) 2024/1689 laying down harmonised rules on artificial intelligence (Artificial Intelligence Act). In parallel, it examines the jurisprudence of the Court of Justice of the European Union (CJEU), the European Court of Human Rights (ECtHR), and the Council of State of Greece (Symvoulio tis Epikrateias – StE), with particular emphasis on access to justice, the duty to provide reasons, access to environmental information, and the legal requirements of algorithmic transparency.

The analytical framework is developed through a series of case studies addressing forest wildfires, air quality management, renewable energy projects, and the use of algorithmic systems within public administration. The thesis concludes that the institutional deployment of artificial intelligence is compatible with the requirements of environmental rule of law only insofar as it serves as an instrument of scientific and evidential support, rather than as a substitute for human responsibility, legal judgment, or effective judicial scrutiny.

Accordingly, the thesis advances a normative model of accountable technological prevention, capable of reconciling technological innovation with the fundamental principles of transparency, proportionality, human oversight, and the effective protection of individual rights within the framework of the environmental rule of law.
